LANDLORD/TENANT DISPUTES

Are you a landlord who needs to start the eviction process for unpaid rent or other violations of the rental agreement? Or are you trying to collect for damage to the property? Once you contact The Kimball Firm, we will immediately begin the eviction or collection process.  Our goal is to get problem tenants out of the property as soon as possible.

In Florida, both landlords and tenants have rights.  In addition to representing landlords, we also represent tenants who believe their rights are not being respected.  If you are a tenant who has been threatened with eviction or your landlord has not provided you with a safe and habitable residence, The Kimball Firm is here to help you!  We can walk you through the eviction process to help ensure the landlord follows proper eviction procedures--it may be even possible to extend the time constraints or even fight the validity of the eviction. If there is deficiencies at the property we can help you get the remedy you need.

BUSINESS CONTRACTS LEGAL SERVICES

Sometimes people can make an agreement on a handshake. But honestly, how often does that turn out well? The problem is that the handshake agreement leaves out the details. The parties are prone to misconceptions, misunderstandings, differing expectations, and ultimately, disappointment.

Successful business owners document every transaction with a well drafted contract, one that is clear, concise and accurately reflects the agreement of the parties. When a question arises about their respective rights or responsibilities, all they have to do is refer to the contract for an answer.

The Kimball Firm is here to help! We can review your existing contracts for deficiencies or we can draft a new contract to suit your business needs.

FAMILY LAW

Ending a marriage impacts every aspect of your life. It is not just a legal problem. Divorce changes your marital status, your financial situation, your relationship with friends, family and even your own children. Divorce changes the way you feel about yourself and brings with it huge emotional changes and traumas. Virtually every part of your life will be touched and in almost all instances the impact will be negative.

We strive to help our clients through their divorce with professionalism, integrity and compassion. From child support and alimony to parenting plans and time sharing we will talk about it and plan for all possible paths.  We believe that in order to successfully represent you, we must devise a holistic approach that helps you deal with not only your legal problems, but that helps you re-organize your life as well!

ENFORCEMENT ACTIONS

What do you do when your ex-spouse refused to comply with the Court’s orders as contained in the Final Judgment, your Marital Settlement Agreement or in a Parenting Plan or stops paying Child Support?  Your ex-spouse’s failure to comply with the terms of a court order can be effectively dealt with by your retaining an attorney who handles marital and family law matters to enforce the terms and conditions of the various orders entered in your case.

The Kimball Firm can help you obtain enforcement of a court order if the other party is not fulfilling his or her duty or if the other party is interfering with your right to time-sharing.  Contact us to get started today.

PATERNITY ACTIONS

As a father, your relationship with your child is extremely important. Every child should have both parents involved in his or her life when it is in the child’s best interests. In order to ensure that you have legal rights as a father, such as custody and visitation, you will need to establish paternity.

In Florida, paternity can be established in a number of ways. However, if paternity is not established, a father could lose all rights regarding his child. Paternity gives a man equal rights to decision-making aspects of his child’s life, as well as parenting time and child support. If you are a father and have not yet established paternity, or if you are facing divorce and need to protect your rights as a father, The Kimball Firm can help.

Your Attorney

Shannon Clancy-Kimball
Principle Shareholder

Shannon Clancy-Kimball's commitment to providing personalized service with a family atmosphere began in her small hometown of Babson Park, Florida.  There, she graduated first in her class at an internationally renowned business school, Webber International University, where she majored in Marketing and Business Management.  Shannon then attended the University of North Florida and attained her Masters of Business Administration degree.  It was also where she first got bit by the travel bug - she studied abroad in the Czech Republic and Poland and has since travelled to more than thirty countries.

She graduated from the Stetson University College of Law where she concentrated in advocacy and legal research as well as continued to pursue her passion for international studies.  She studied abroad at the University of Nankai in Tianjin, China, and at the University of Freiburg in Freiburg, Germany.  At Stetson she was a member of the Moot Court Board, Advocacy Board Arbitration Team, and Law Review.  In 2008 her team won the National ABA Arbitration Competition, beating out teams from around the country.  This was the first time a team from Stetson won this competition.  Shannon was also a teaching fellow for the legal writing clinic and was on the student governing board.

Shannon has worked for both the State Attorney's Office in Pinellas County and Polk County as well as was a Public Defender in Hillsborough County--exposing her to both sides of the law.  She has also worked at a family law boutique firm in Tampa where she learned how to handle divorce proceedings, custody disputes, and child support/time sharing issues.  Most recently she worked as a legal liaison for a large Florida non-profit handling matters ranging from landlord-tenant issues to negotiating complex contractual matters.  Throughout her six year career, she has tried over seventy-five jury and non-jury making her a well-rounded advocate to defend your rights.

In her spare time Shannon enjoys spending time with her husband, Brian, running Disney races, and volunteering.
